GigReal Privacy Policy

This GigReal privacy policy (the “Privacy Policy”) is designed to inform you (“You” or “User”) about GigReal App LLC’s (“GigReal,” “we,” “us,” or “our”) collection, use, processing, and disclosure of your information in the conduct of GigReal’s business. The Privacy Policy applies to all users of the GigReal platform, which provides gig-driving information, insights, and tools to customers, including ride-hailing, taxi, and delivery drivers (the “Service”). The Service includes (a) the GigReal website (the “Site”), (b) the GigReal mobile app (the “App”), and (c) the services provided to You through the App or the Site. GigReal’s Terms of Service are incorporated herein by reference. All defined terms in the Privacy Policy shall have the same meaning as defined in the Terms of Service.

By using the Service, You are consenting to GigReal’s collection, use, processing, and disclosure of Your information as set forth in this Privacy Policy, which may be modified as reflected in the date the policy was “Last Updated,” above. You should review this Privacy Policy from time to time to stay informed about any changes. If You do not consent to GigReal’s collection, use, processing, and disclosure of Your information, do not use the Service or any portion thereof.

1. DEFINITIONS

A. “N-PII” is non-personally identifiable information obtained through Your use of the Service. This includes anonymized and aggregated data, as discussed in Section 6 below.

B. “PII” is personally identifiable information obtained in connection with providing a product or service to You. It may include information such as name, email address, and phone number that You provide to GigReal. PII does not include information that has been made anonymous or aggregated so that it can no longer be used, whether in combination with other information or otherwise, to contact or identify You.

2. HOW GIGREAL SENDS INFORMATION TO YOU

A. As part of the Service, GigReal may provide You with information about gig opportunities and related insights in your local area. GigReal may send You this information through email, the App, or other channels.

B. GigReal may also send You information through email, the App, or other channels. You may opt-out of receiving commercial messages from us through email by clicking on the “Unsubscribe” link contained in each email. To opt-out of all messages, You must delete Your account.

3. INFORMATION GIGREAL COLLECTS

A. We collect the following types of information from and about users of our Services:

  • Personally Identifiable Information (PII): Your name, email address, phone number, and information obtained from linked gig platforms regarding your gig activities with platforms like Uber or Lyft.
  • Non-Personally Identifiable Information (N-PII): Necessary data required for the use of the app, excluding PII.
  • Location Data: Precise or approximate location data for mileage tracking and enhancing app experience.

B. When You use the Service, GigReal collects PII and N-PII about You from the following sources:

  • Information Transmitted from Your Mobile Device: Including location data as described in Section 3.E.
  • Information You Provide: Information You create or give GigReal through the App or Site, including data from linked accounts.
  • Information from Third Parties: Information collected via authorized partners from gig platforms like Uber or Lyft.

C. Registration

To use the Service (apart from the publicly available portion of the Site), You must provide GigReal with the following information: username, email address, phone number, and create a password. You may also need to provide your zip code to access certain features of the Service. Additionally, You may choose to add other information to Your account.

D. Use of Cookies and Related Technology

Currently, GigReal does not use cookies or similar tracking technologies. If this changes in the future, we will update this section accordingly.

E. Collection of Location Information

GigReal collects precise or approximate location data to provide mileage tracking and enhance your app experience. This data may be collected via GPS, IP address, or other location-based technologies. Location data is used to offer personalized gig opportunities and improve app functionality.

F. Log Files, IP Addresses, and Information About Your Device

GigReal may automatically receive information such as the URL of the site from which You came, the site You are going to, Your IP address, Your device type, operating system, and browser type. This information helps us improve the Service and ensure its security.

G. Usage Data

GigReal collects information about how You use the Service, including Service performance, clicks, access times, and usage patterns. This data helps us enhance the Service and provide a better user experience.

4. USE OF PII

A. GigReal may disclose the information collected from You, including PII, in accordance with Section 7 (“When GigReal May Disclose Your Information”), below.

B. GigReal uses and/or intends to use PII to:

  • Operate and improve the Service.
  • Create and manage Your account.
  • Provide You with the Service and other products and services You request or express interest in.
  • Notify You about Service availability in Your area.
  • Facilitate subscription processing, reviews, and analysis.
  • Evaluate Your interests and needs to improve the Service and offer additional products or services.
  • Track use of the Service.
  • Provide customer support.
  • Communicate and provide additional information of interest to You through email or other means, such as special offers, announcements, and marketing materials.
  • Send You reminders, technical notices, updates, security alerts, support messages, service bulletins, or marketing communications.
  • Manage GigReal’s everyday business needs, including Service administration, analytics, fraud prevention, and compliance with legal obligations.
  • Conduct research based on Your responses to surveys that we may ask You to complete.

C. This Privacy Policy does not limit GigReal’s use of any N-PII, and GigReal reserves the right to use and disclose such information to third parties at GigReal’s discretion.

5. LINKS/POSTINGS TO OTHER SITES

You may access the Service on a third-party website and/or the Service may contain links to other websites. GigReal is not responsible for the actions, practices, or content of such websites linked to or from any part of the Service. You understand that such websites may have their own legal documents to which You must agree prior to using, and GigReal has no control over, these legal documents. It is Your responsibility to verify Your legal use of a website as well as use of information from the website with the corresponding website owner. GigReal does not guarantee, approve, or endorse any information, material, services, or products contained on these third-party websites. GigReal is not responsible for any content on sites linked from or to the Service or for obtaining any necessary consent for such third-party websites to collect, transmit, or otherwise use Your information.

6. USE OF ANONYMIZED AND AGGREGATED DATA

GigReal anonymizes all data before sharing it with or selling it to third parties. GigReal may also combine your anonymized N-PII with information from other users to create aggregated data products, which may be disclosed or sold to third parties.

7. WHEN GIGREAL MAY DISCLOSE YOUR INFORMATION

A. Except as set forth in this Privacy Policy or as specifically agreed to by You, GigReal will not disclose any PII gathered from You through the Service.

B. Third-Party Sharing:

  • GigReal utilizes trusted third-party service providers to store and process user data securely.
  • GigReal collaborates with authorized partners to collect information from gig platforms like Uber or Lyft.
  • These third-party services are essential for providing the Service and are bound by confidentiality agreements to protect Your PII.

C. Legal Requirements:GigReal may disclose Your PII if required to do so by law or in response to valid requests by public authorities (e.g., court orders, subpoenas, warrants). Additionally, GigReal may disclose Your information to protect the rights, property, or safety of GigReal, our users, or others.

D. Business Transfers:If GigReal is involved in a merger, acquisition, or sale of all or a portion of its assets, Your PII may be transferred as part of that transaction. GigReal will notify You via email and/or a prominent notice on the Service of any change in ownership or uses of Your PII.

E. Other Disclosures:GigReal may share Your user name, avatar, and messages to other users of the Service upon Your request. Communications on public forums or to other users may be viewable by the public.

F. Marketing Opt-Out:If You prefer that GigReal does not share certain information with its contractors and service providers for marketing purposes, You can direct GigReal not to share that information by contacting us at support@gigrealapp.com. Please note that this opt-out is effective only with respect to information sharing for advertising and marketing.

8. DATA SECURITY

A. GigReal limits access to users’ PII to employees, agents, and affiliates who need the information to fulfill their business responsibilities and who are under obligations of confidentiality.

B. GigReal utilizes various information security measures to protect Your PII, including encryption, secure servers, and internal access controls. Your data is encrypted and stored securely using industry-standard infrastructure.

In the event of a data breach, GigReal is committed to taking swift and effective action to protect your information. Our data breach response plan includes the following steps:

  1. Identification and Assessment:
    • Immediate Action: As soon as a data breach is detected, GigReal’s security team will assess the scope and impact of the breach.
    • Containment: Steps will be taken to contain the breach and prevent further unauthorized access.
  2. Notification:
    • Affected Users: If the breach involves PII that compromises user security, GigReal will notify affected users via email within 72 hours of discovering the breach. The notification will include:
      • A description of the breach.
      • The types of information involved.
      • Steps GigReal is taking to address the breach.
      • Recommendations for users to protect themselves (e.g., changing passwords, monitoring accounts).
    • Regulatory Authorities: GigReal will comply with all applicable laws regarding breach notifications and report the breach to relevant authorities as required.

    • Investigate: Conduct a thorough investigation to understand how the breach occurred and which systems were affected.
    • Remediation: Implement measures to fix vulnerabilities that led to the breach and enhance security to prevent future incidents.
  4. Communication:
    • Internal Communication: Inform GigReal employees and stakeholders about the breach and the steps being taken.
    • Public Communication: If necessary, GigReal may issue a public statement to inform the broader user base and maintain transparency.
  5. Review and Improve:
    • Post-Incident Review: Analyze the breach to identify lessons learned and areas for improvement.
    • Update Policies: Revise security policies and procedures based on insights gained from the breach.
  6. Support:
    • User Support: Provide support to affected users, such as assistance with securing their accounts or answering questions about the breach.
    • Monitoring: Offer services like credit monitoring if sensitive information was compromised, depending on the severity of the breach.

Note: GigReal is continuously working to prevent data breaches through robust security measures and regular security assessments. However, no system is entirely immune to threats, and we encourage users to take proactive steps to protect their personal information.

9. TRANSFER OF OWNERSHIP

If the entire or a substantial portion of GigReal’s ownership changes, or in the event of another sale or transfer of some or all of GigReal’s assets, Your user information, including PII, may be transferred to the new owner to ensure the continuity of the Service. In any such transfer of information, Your user information, including PII, will remain subject to the promises of GigReal’s then-current Privacy Policy.

10. COMPLIANCE

A. Applicable Laws:GigReal complies with applicable United States privacy laws and regulations governing the protection of PII and data. As GigReal is initially operating solely within the United States, compliance with U.S. laws such as the California Consumer Privacy Act (CCPA) may apply depending on your user base.

B. International Users:Currently, GigReal is available only in the United States. If the Service is expanded internationally in the future, GigReal will update this Privacy Policy to address data handling practices for users outside the United States.

11. COOKIES AND TRACKING TECHNOLOGIES

A. Usage:Currently, GigReal does not use cookies or similar tracking technologies. If this changes in the future, we will update this section accordingly.

B. Management:As GigReal does not use cookies at this time, there are no cookie preferences to manage.

12. CHILDREN’S PRIVACY

A. Age Restrictions:GigReal is intended for users who are eighteen (18) years of age or older. The Service is designed for gig workers who can benefit from the tools and information provided.

B. Protection of Children’s Privacy:GigReal does not knowingly collect or maintain PII from users under eighteen (18) years of age. If You are under eighteen (18) years of age, please do not use or access the Service. If GigReal becomes aware that it has inadvertently collected PII from a user under eighteen (18) years of age, GigReal will take appropriate steps to delete such information promptly.

13. POLICY UPDATES

A. Notification:GigReal may update this Privacy Policy from time to time. When significant changes are made, GigReal will notify You through the App by sending an update notification. Users will be prompted to agree to the updated Privacy Policy upon their next login or app use.

B. Effective Date:This Privacy Policy is effective as of the date listed above. Any updates will become effective immediately upon posting on the Site and within the App, with notifications as described in Section 13.A.
